Patent Prosecution Highway (PPH) – Expedited Examination of Applications


The Patent Prosecution Highway (PPH) speeds up the examination process of corresponding applications filed in participating intellectual property offices.

Under the PPH, participating patent offices have agreed that when an applicant receives a final decision from a first patent office that at least one claim is authorized, the applicant may request an expedited examination of the claim (s). corresponding documents in a corresponding pending patent application. in a second patent office. PPH takes advantage of expedited examination procedures already in place among participating patent offices to enable applicants to reach the final decision on a patent application faster and more efficiently than standard examination processing.

Request an expedited review under the PPH

We are pleased to announce that on January 6, 2014, the USPTO launched pilot projects that simplify access to participating PPH offices. The new pilots – formulated under the auspices of Global PPH and IP5 PPH – replace existing forms and procedures that were unique to each pair of PPH countries, with a common form and rules for participating countries.

The Global PPH and IP5 PPH pilot programs will operate simultaneously and are substantially identical, differing only with respect to their respective participating offices. Since the USPTO has chosen to participate in both the Global PPH Pilot Program and the IP5 PPH Pilot Program, a PPH application can be filed with the USPTO based on the work product of any office participating in the one or the other pilot program. Additionally, since the respective requirements of the Global PPH and IP5 PPH pilot programs are equivalent, USPTO applicants do not need to specify which pilot program is being used.

Any previous positive results (whether PCT or national work product) from any of the IP offices listed below can potentially form a basis for PPH status at the USPTO under these new programs. simplified pilots.
